Terms of service

These Terms of Service ("Terms") govern your use of TinyStar Books and your purchase of personalized children's books from No Worries! Lifestyle, LLC ("we," "us," or "our"). By using the service, placing an order, or checking the consent box at checkout, you agree to these Terms, our Privacy Policy, and the Consent Form. If you do not agree, do not use the service.

1. Eligibility

You must be at least 18 years old and able to enter into a binding contract. When you provide a child's photo and details, you confirm that you are that child's parent or legal guardian and that you have the right to provide that photo and information to us for the purposes described in these Terms and our Privacy Policy.

2. The service

We create personalized children's books. Using a photo and details you provide, we generate AI-illustrated artwork and a personalized story, have a person review it for quality and safety, and produce a physical book and/or a digital PDF. Each book is generated uniquely; the art style you choose sets the look and feel, but results vary from order to order.

3. Your content and the rights you grant us

You keep ownership of the photo and details you upload ("Your Content"). You grant us a limited, non-exclusive license to use Your Content solely to create, review, produce, fulfill, and support your order, and to operate the service as described in our Privacy Policy. You represent and warrant that you have all rights and permissions necessary to provide Your Content and that it does not infringe anyone's rights or violate any law.

4. AI-generated artwork

The artwork and story are generated by artificial intelligence and then reviewed by a person. They are interpretations inspired by the photo you provide — they are not photographs, are not guaranteed to be an exact likeness, and will differ between orders. By ordering, you understand and accept the AI-generated nature of the product.

5. Orders, pricing, and payment

Prices, products, and availability are shown at checkout and may change. Payment is processed securely through Shopify and its payment partners. We may refuse or cancel an order — for example, if it cannot be produced, appears fraudulent, or violates these Terms — and will refund any amount charged for an order we cancel before production.

6. Acceptable use and prohibited content

You agree not to upload or request content that: is not a photo of your own child or a child you are the legal guardian of; depicts another person without authority; is unlawful, harmful, hateful, sexually explicit, or exploitative; or infringes intellectual property or privacy rights. You also agree not to misuse, copy, scrape, or interfere with the service.

7. Custom products, cancellations, and refunds

Each book is custom-made to order based on the details you provide, so cancellations and returns are limited. Our cancellation, return, and refund terms are set out in our Refund Policy, which forms part of these Terms. Please review your order details carefully before checkout.

8. Intellectual property

We and our licensors own the service, including our software, templates, models, designs, and branding. When your order is complete, you receive the finished book (physical and/or digital) for your personal, non-commercial use. You may not resell, mass-reproduce, or commercially exploit the book or its contents without our written permission.

9. Content review and safety

To keep the service safe, we may screen and review uploaded photos and generated images. We may block, refuse, or stop any order, and if we detect content we reasonably believe may be illegal — in particular content that may depict the sexual abuse or exploitation of a child — we will preserve and handle the material and report it to authorities as required by law. 10. Disclaimers

The service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any result will meet your expectations.

11. Limitation of liability

To the fullest extent permitted by law, No Worries! Lifestyle, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill. Our total liability for any claim relating to the service or an order will not exceed the amount you paid for that order.

12. Indemnification

You agree to indemnify and hold harmless No Worries! Lifestyle, LLC from any claims, damages, and expenses arising out of Your Content, your use of the service, or your breach of these Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute will be subject to the state and federal courts located in Texas, unless applicable law provides otherwise.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here with a new "Last updated" date. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.
